We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

3. No Contracts — Cancellation Policy

We offer month-to-month services with no long-term contracts. You may cancel your monthly service at any time by providing written notice to info@suncoastwebdesign.com at least 7 days before your next billing date.

We make reasonable efforts to maintain website uptime and performance. However, we do not guarantee uninterrupted service. We are not liable for downtime caused by third-party hosting providers, scheduled maintenance, cyberattacks, or circumstances beyond our control.

To the fullest extent permitted by Florida law, Suncoast Web Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of our services.

Our total liability to you for any claim arising from these Terms or our services shall not exceed the total amount paid by you to us in the three (3) months preceding the claim.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable Florida law.

You agree to indemnify, defend, and hold harmless Suncoast Web Design and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of our services, your violation of these Terms, or your infringement of any third-party rights.

Nothing in these Terms is intended to limit any rights you may have under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), Fla. Stat. § 501.201 et seq., or other applicable Florida consumer protection laws.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved in the state or federal courts of Sarasota County, Florida, and both parties consent to personal jurisdiction in those courts.

13. Modifications to Terms

We reserve the right to update these Terms at any time. We will notify active clients of material changes via email. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and Suncoast Web Design regarding your use of our services and supersede all prior agreements and understandings.
